Prescription Action Litigation Project

MASSPIRG joined the Prescription Action Litigation Project in suing pharmaceutical giants for price gouging and anti competitive practices. The class-action lawsuits challenge pharmaceutical companies for illegal practices in the sale of leading prescription drugs including: Claritin, Lupron, BuSpar, Tomoxifen, and Cipro among others. The illegal practices include advertising fraud, unfair billing practices and artificial price inflation.

MASSPIRG's goal is to use the class action lawsuits to force pharmaceutical companies to end their unfair and illegitimate practices they use to abuse their monopoly power and keep prices high. One anticipated favorable outcome is that generic drug makers will be able to come to market without interference from the brand-name manufacturers. Generic drugs are typically priced at 30-80% below the brand-name drug. Our longer-term goal is to put an end to drug company practices that keep the cost of drugs prohibitively high.
